Business Kenesh considers proposals of business associations for the protection of entrepreneurs' rights

“We should prioritize addressing systemic issues concerning a wide range of business entities,” said Deputy Executive Director of the International Business Council (IBC) Dastan Imanaliev at a meeting of the Business and Entrepreneurship Development Council under the Parliament Speaker.

The meeting participants discussed the issues to be included in the Council’s Action Plan. Within two days, the Council working groups considered 43 proposals from various business associations, including IBC, Association of Telecom Operators, Chamber of Tax Consultants, NABA, JIA, Business Ombudsman Institute, Union of Banks, and others. The meeting was chaired by the head of the Council’s secretariat Aida Isabek.

IBC submitted several proposals to the Council for consideration, including amendments to labor legislation, the Tax Code, the Criminal Procedure Code and the Criminal Code of the Kyrgyz Republic.

The draft law on amending the Criminal Procedure Code and the Criminal Code was developed by an expert group of the business community at the IBC initiative to address problematic issues voiced by entrepreneurs at the second meeting of the Industry and Entrepreneurship Development Committee under the National for Sustainable Development Council of the Kyrgyz Republic.

“We have developed this bill to ensure the protection of the rights of entrepreneurs from unjustified criminal prosecution in tax legal relations,” explained Imanaliev.

The proposals of the business community on amendments to the Labor Code refer to disputes over unpaid wages. According to the Labor Code, the statute of limitations does not apply to the unpaid wages. IBC proposed to exclude this provision and establish that in disputes over the unpaid wages, an employee has the right to go to court within one year from the day he/she learned about the violation of his/her rights.

Another IBC proposal will help improve the quality of air passenger service.

IBC proposed to amend the Tax Code, exempting domestic air carriers from paying VAT on imports of aircrafts, engines and spare parts into the territory of Kyrgyzstan.

]“Our domestic airlines are now in an unequal competitive environment with their counterparts from the EAEU countries that enjoy benefits. The proposed changes to the Tax Code will create conditions for the development of civil aviation in Kyrgyzstan," Imanaliev concluded.
