IBC makes suggestions for implementation of the Unified Crime and Misconduct Register

On February 21, 2020, an expert discussion of law enforcement practices related to economic activities in the framework of the judicial reform in Kyrgyzstan was held to improve the system of protecting the rights of entrepreneurs.

The event was held following the results of the second meeting of the Industry and Entrepreneurship Development Committee under the National Sustainable Development Council of the Kyrgyz Republic.

The roundtable was attended by the Head of the Judicial Reform and Rule of Law Office of the President of the Kyrgyz Republic, Sanjar Isabaev, Deputy Head of the Expert Working Group on monitoring activities in the framework of judicial reform Gulmira Mamatkerimova, Deputy Business Ombudsman Sergey Ponomarev, Executive Director of the International Business Council Askar Sydykov, representatives of business community.

“Since 2019, new codes have begun to operate which contain good ideas. Now we need to improve them in connection with the current situation, especially in terms of protecting entrepreneurial activity,” Sydykov said.

Many economic crimes have been decriminalized in the new codes compared to past ones, but in the procedural part there are points that need to be improved.

The International Business Council proposed to extend the time limit for considering applications either before entering them into the Unified Crime and Misconduct Register (ECMR), or after entering them into the ECMR, but before the pre-trial procedure.

“Business has many suggestions for improving legislation in the field of entrepreneurship, and we are ready to discuss them openly and constructively,” Askar Sydykov concluded.

Following the roundtable discussions, it was decided to finalize the participants’ proposals and consider them in two weeks.
