How to remove administrative barriers in the construction sector

On January 5, 2021, the Interdepartmental Working Group on simplification of administrative procedures in the construction sector of Kyrgyzstan began to solve this problem.

The IWG was created as part of the activities of the Economic Reforms Council under the Government of the Kyrgyz Republic. IBC representative is a IWG member.

Reducing the time for issuing documents for design and construction

The participants of the meeting considered amendments to the Regulation on the procedure for issuing documents for design, construction and other changes to real estate facilities in the Kyrgyz Republic.

Currently, all stages of obtaining permits, including the consideration of a draft design by the city planning council, development of architectural, planning, engineering and technical design, approval and examination (12 stages in total) require 94 working days.

Experts suggested using an option that practically halves these terms — up to 48 working days.

Combining design and construction processes

In order to start construction and installation works, the developer needs to get a positive conclusion of all types of expertise — construction and technical, fire and technical, environmental and industrial safety.

The problem is that it is necessary to develop design documentation for all sections (architectural, structural, engineering support, etc.) before the start of construction, which delays the implementation of construction intentions.

Possible solutions to the problem are proposed by the draft Law of the Kyrgyz Republic "On Amendments to Certain Legislative Acts of the Kyrgyz Republic in the Construction Sector", which was adopted by the Parliament on November 25, 2020 and submitted for signing to the President of the Kyrgyz Republic.

Design documentation intended for construction is subject to examination in 4 state authorized bodies:

- Gosstroy — construction and technical expertise;

- Ministry of Emergency Situations — fire safety;

- SAEPF — environmental safety;

- GKPEN — industrial safety.

For the Gosstroy, the government has established terms from 10 to 30 working days, for the Ministry of Emergency Situations — up to 14 working days, the State Agency for Environmental Protection and Forestry — up to 90 calendar days and GKPEN — up to 30 working days.

A developer-investor faces a lot of problems when obtaining an opinion on all types of examinations due to losses of time, a different approach to organizing examinations. As a result, all types of examinations take about six months. This delays the start of construction and affects the duration of construction, the efficiency of the use of financial resources, and negatively affects the investment attractiveness of the country.

Gosstroy has developed a bill providing for the introduction of a comprehensive examination of design and estimate documentation for construction projects and other changes to real estate in the Kyrgyz Republic. The bill provides for the consideration of project documentation and the issuance of opinions on the single window principle; reduction of terms and improvement of the quality of examination; exclusion of contact between the customer and experts, reduction of corruption risks; and optimization of the processes of issuing permits.

Industry transition to information modeling

The introduction of BIM technologies (Building Information Modeling) will help solve these problems.

The first stage is to oblige the use of BIM-technologies in the course of design, construction and operation of facilities financed from the state budget.

The BIM technologies introduced at the design stage speed up the designer's work by reducing labor intensity at the time of making changes to projects, greatly facilitating the search and elimination of errors, as well as communication with customers and contractors thanks to special tools for teamwork and finding collisions.
