The Economy Ministry submits a draft law for public discussion

Since August 23, 2019, the Ministry of Economy of the Kyrgyz Republic has submitted for public discussion the draft Law of the Kyrgyz Republic “On Amending Certain Legislative Acts of the Kyrgyz Republic to bring it into compliance with the codes of the Kyrgyz Republic on violations and misconduct” and the draft resolution of the Government of the Kyrgyz Republic “On the draft Law of the Kyrgyz Republic “On Amending Certain Legislative Acts of the Kyrgyz Republic to Bring It Into Codes of the Kyrgyz Republic on violations and misconduct."

The draft Law of the Kyrgyz Republic “On Amending Certain Legislative Acts of the Kyrgyz Republic to Bring It Into Compliance with the Codes of the Kyrgyz Republic on Violations and Misconducts” was developed to bring the Laws of the Kyrgyz Republic “On State Regulation of Foreign Trade Activities in the Kyrgyz Republic”, “On Advertising” , “On the fundamentals of technical regulation in the Kyrgyz Republic”, “On the fundamentals of technical regulation in the Kyrgyz Republic”, “On state and municipal services" in accordance with the Code of the Kyrgyz Republic of irregularities and misconduct.

The draft law proposes to amend Article 32 of the Law of the Kyrgyz Republic “On State Regulation of Foreign Trade Activities in the Kyrgyz Republic” according to which persons guilty of violation of the legislation of the Kyrgyz Republic on foreign trade activities bear civil, administrative or criminal liability in accordance with the legislation of the Kyrgyz Republic.

Considering that articles 205 and 206 of the Code of the Kyrgyz Republic on Violations define liability for violations related to the implementation of entrepreneurial activities without a license and the provision of false information to obtain a license, articles 92 and 97 of the Kyrgyz Code of Misconduct define liability for misconduct related to fraud and illegal business activities.

Articles 211,213,215,221 and 223 of the Criminal Code of the Kyrgyz Republic define criminal liability for crimes related to illegal business, false entrepreneurship, and economic smuggling.

The draft Law proposes to amend Article 32 of the Law of the Kyrgyz Republic “On State Regulation of Foreign Trade in the Kyrgyz Republic”, which provides for prosecution for violation of the said Law in accordance with the civil and criminal laws of the Kyrgyz Republic and the codes of the Kyrgyz Republic on violations and misconduct.

In accordance with the Constitution of the Kyrgyz Republic, the Law of the Kyrgyz Republic “On regulatory legal acts of the Kyrgyz Republic”, a draft resolution of the Government of the Kyrgyz Republic “On the draft Law of the Kyrgyz Republic“ On Amending Certain Legislative Acts of the Kyrgyz Republic (Tax Code of the Kyrgyz Republic, Law of the Kyrgyz Republic) has been developed “About Advertising”).

According to Article 79 of the Constitution of the Kyrgyz Republic, the Government of the Kyrgyz Republic has the right of legislative initiative. In this connection, the indicated draft resolution of the Government of the Kyrgyz Republic proposes to approve the draft Law of the Kyrgyz Republic “On Amending Certain Legislative Acts of the Kyrgyz Republic (Tax Code of the Kyrgyz Republic, Law of the Kyrgyz Republic “On Advertising”) for further sending the draft Law to the Jogorku Kenesh Kyrgyz Republic.

The Government initiates the transfer of land transformation competencies to local government administrations

On August 22, 2019, the Prime Minister of the Kyrgyz Republic, Mukhammedkaly Abylgaziev, held a meeting to discuss the transfer of land transfer competencies to authorized state bodies.

According to the Prime Minister, the transfer of less valuable agricultural land to more valuable one, equivalent types of agricultural land from one type to another is carried out by local government bodies (arable land, fallow lands, lands occupied by perennial plantations, hayfields, pastures, woody shrub plantings and others). The transfer of the remaining land to other categories is carried out in accordance with the decision of the Government.

This bill has been developed to improve the norms of land legislation in terms of determining the competencies of authorized state bodies in the transfer (transformation) of land.
