The EAEU technical regulations on oil safety will come into force from July 1, 2019

From July 1, 2019, the technical regulation of the Eurasian Economic Union “On the safety of oil prepared for transportation or use” (EAEU TR 045/2017) will come into force in the Kyrgyz Republic.

The technical regulation applies to oil put into circulation in the domestic market of the EAEU, and does not apply to oil supplied by government order and for export to the external market for the EAEU.

Oil is subject to conformity assessment to be carried out in the form of tests with a quality certificate.

Oil testing for compliance with technical regulations should be carried out in company’s own testing laboratory or an accredited testing laboratory included in the Unified Register of Eurasian Conformity Assessment Bodies.

The quality certificate should be issued by the oil producer or the seller (including the importer).

The draft law “On Amendments to Certain Legislative Acts of the Kyrgyz Republic on Land Use Issues” approved in the second reading

On June 12, the Parliament deputies considered the second reading of the draft law “On Amendments to Certain Legislative Acts of the Kyrgyz Republic on Land Use Issues”.

Amendments were made to the following legislative acts: Laws of the Kyrgyz Republic “On Electric and Postal Communication”, “On Pastures”, “On Transfer (Transformation) of Land Plots”, “On Specially Protected Natural Territories”, the Land Code, the Water Code, and the Forest Code.

The draft law was developed in order to solve existing problems related to the procedure for obtaining land plots to accommodate communication facilities and to simplify it.

In particular, it is proposed to introduce a rule permitting the provision of temporary use of land plots of a size not exceeding 20 m² for the construction or installation of communication facilities without transferring (transforming) land from one category to another or from one type of land to another.

The draft law “On the Procedure for Conducting Inspections of Entrepreneurship Entities” discussed

On June 12, MPs considered the first reading of the draft law “On Amendments to the Law of the Kyrgyz Republic “On the Procedure for Conducting Inspections of Entrepreneurship Entities”.

The draft law was developed for the purpose of a full-fledged and high-quality verification of all objects of a business entity in the energy sector.

According to the Law of the Kyrgyz Republic “On the Procedure for Conducting Inspections of Entrepreneurship Entities”, depending on the degree of risk, the authorized body determines the frequency of scheduled inspections, but not more than once a year for entities with a high degree of risk. Objects of the energy sector, according to Government Resolution dated February 18, 2012 No. 108, are objects with a high degree of risk.

Ministry of Justice submits to the public discussion the draft NLA

Since June 13, the Ministry of Justice of the Kyrgyz Republic has submitted for public discussion the draft Law of the Kyrgyz Republic “On Amendments to Certain Legislative Acts in the Field of Land Use (Law of the Kyrgyz Republic “On Introducing a Moratorium on the Transfer (Transformation) of Arable Land to Other Land Categories and Land Types”, Criminal Code of the Kyrgyz Republic)."

Parliament Committee considers amendments to the Law on Pastures

On June 10, 2019, the Parliament Committee on Agrarian Policy, Water Resources, Ecology and Regional Development approved the third reading of the draft Law “On Amendments to the Law of the Kyrgyz Republic “On Pastures”.

The draft law was developed in order to bring it in compliance with the norms of the Land Code of the Kyrgyz Republic, in terms of providing land for subsoil use without transferring (transforming) into another category of land.

The main problem of obtaining land plots by subsoil users is the impossibility to obtain title deeds for pasture land. To ensure the possibility of grazing land for all types of minerals, it is proposed to revise the concept of “using pastures for other purposes”.

Parliament Committee approves a draft law on harmonization of legislation in the financial market of the EAEU Member States

On June 10, 2019, the Parliament Committee on Budget and Finance reviewed and approved the draft law “On Ratification of the Agreement on Harmonization of the Laws of the Member States of the Eurasian Economic Union in the Financial Market, signed on November 6, 2018 in Moscow” in the first reading.

The agreement provides for the order of harmonization of legislation of the EAEU Member States in the banking and insurance sectors, as well as the services in the securities market based on international principles and standards or international best practices in the financial market regulation.
